İslam Hukukunda Hayvan Alım-Satımı ve İlgili Hükümler
Abstract
ABSTRACT:
The sale and purchase of animals in Islamic law involve various juristic issues concerning whether an animal qualifies as property and as mutaqawwam property, whether a legally recognized benefit may be derived from it, and whether the contract of sale fulfils the required conditions of validity. This study aims to examine the legal rulings concerning animal sales, compare the approaches adopted by the Islamic schools of law, and identify the principal juristic criteria underlying these rulings.
The study adopts a comparative Islamic jurisprudence approach and examines the views of the Hanafi, Maliki, Shafi‘i, and Hanbali schools on the basis of their primary sources. Within this framework, the fundamental principles governing the formation and validity of a contract of sale and the concept of mutaqawwam property are first examined. The study then evaluates such matters as gharar, uncertainty, the sale of non existent subject matter, deliverability, and co ownership, all of which may affect the legal status of animal sales. Classical forms of sale, including the sale of an animal’s offspring or unborn young, habal al habala, madamin, and malaqih, as well as the sale of different animal species, are examined in terms of legally recognized benefit, ownership, purity and impurity, and the possibility of delivery.
The findings demonstrate that the legal ruling concerning the sale of an animal does not depend solely on whether its meat is lawful or unlawful for consumption. The main criteria determining whether an animal may constitute the subject matter of a valid contract of sale are that it can be legally owned and delivered, that the subject matter of the contract is sufficiently specified, and that a legally recognized benefit can be derived from it. The differences among the Islamic schools of law primarily arise from their respective interpretations of the scope of legally recognized benefit, the status of animals in terms of purity and impurity, their qualification as mutaqawwam property, and the relevant textual evidence. Accordingly, the legal status of animal sales requires a comprehensive assessment that considers both the characteristics of the animal and the religious and legal nature of the benefit derived from it.
