أثر حروف الجر في استنباط الأحكام الفقهية

Abstract

ÖZET: Arap dili, sahip olduğu etkin betimleme ve açıklama gücü nedeniyle önemli bir role sahip olduğu gibi cer harflerinin Arap dilinde ve fıkhî hükümlerin istinbatında önemli bir yeri vardır. Zira cer harflerinin her birisinin farklı anlamları bulunmaktadır ve her birinin Kur’an ve hadislerden hüküm elde etmede büyük etkisi vardır. Cer harflerinin bu önemine binaen fıkıh، gramer ve dil kaynakları ışığında (Fıkhi Hükümlerin Tespitinde Harf’i Cerlerin Rolü) konusunu tercih ettik. Konuyu önemine binaen derinlemesine işledik. Zira anlamlar dil ile ifade edildiği gibi Kur’an ayetlerinde ve peygamberin hadislerinden hüküm dil ile elde edilir. Kapsamlı şekilde incelenebilmesi amacıyla konuyu üç bölümde ele aldık. Birinci bölümde harfin sözlük ve terim olarak mahiyeti ele alındıktan sonra ( ب،ك،ل ) harflerinin anlamları ile yemin edatı olan (ت) ile (و) harflerinin anlamı incelenmiş ve ilgili âyetler ile âlimlerin konu hakkındaki görüşlerine değinilmiştir. İkinci bölümde cer harflerinden ( فِي، عنْ ، مِنْ ، إِل ى، عل ى، رُ ب ، حتى، حاشا ) edatları ve bunlarla ilgili âyetler ile ulemânın görüşleri işlenmiştir. Üçüncü bölümde ise cer harfleri ve anlamları ile ilgili en önemli fıkhî konular ele alınmıştır. Araştırma neticesinde şu sonuçlara vardık: Arap dili açısından büyük bir öneme sahip olan harfler، nahiv açısından da önemli bir yere sahiptir. Cer harflerinin sahip olduğu önem، birden fazla anlam taşımalarından kaynaklanmaktadır. Bu harflerin her biri bazen cümlenin akışıyla belirlenebilecek birden fazla anlam taşımaktadır. Ayrıca bu harfler fiilin yerine kullanılmaktadır. Örneğin (ب) harfi bitişme fiilinin، (ك) benzetme fiilinin yerine geçmiştir. Aynı şekilde diğer harfler de farklı fiillerin anlamını ifade eder. Kur’anda kullanılan cer harflerinin anlamlarının tefekkürü ve derinlemesine incelenmesi، ayetlerin fıkıh، tefsir، inanç ve diğer açılardan sağlıklı bir şekilde anlaşılmasına yardımcı olmaktadır.

ABSTRACT: The Arabic language has a significant role due to its effective descriptive and explanatory powers and the preposition letters play a significant role in the Arabic language and revelation of the provisions of Islamic jurisprudence. Because each preposition letter has a different meaning، and each is significant in obtaining provisions from the Koranic and Hadith texts. Due to this significance of preposition letters in Arabic، we preferred to scrutinize the effect of preposition letters on the revelation of Islamic jurisprudence provisions based on the legal، grammar and language resources in the present study. We studied the topic in depth due to its significance. Because، as the meanings are expressed in language، the provisions of the Qur'an and the hadith are obtained through language. We discussed the topic in three sections for a comprehensive analysis. In the first section، the dictionary meaning of the letter as a term was addressed ( ب،ك،ل ) and the meanings of the letters (ت) and ( و(، which are oath prepositions، were examined and the related verses and the views of the scholars on the topic were mentioned. In the second section، the prepositions letters ( فِي، عنْ ، مِنْ ، إِل ى، عل ى، رُ ب ، حتى، حاشا ) and related verses and the views of Islamic scholars on these letters were described. In the third section، the most important jurisprudential issues concerning the preposition letters and their meanings were discussed. Findings of the present study demonstrated that the letters that are significant for Arabic language were also significant for syntax. The significance of the preposition letters was due to the fact that they have several meanings. Each letter has more than a single meaning that could often be determined by the flow of the sentence. Furthermore، these letters could also be used to replace the verb. For example، the letter (ب) replaces the verb conjugation، (ك) replaces the verb liken. Similarly، other letters reflect the meanings of different verbs. In depth analysis and contemplation of the meanings of the preposition letters utilized in Qur’an enables the understanding the verses more clearly with respect to Islamic jurisprudence، hermeneutics، belief and other aspects.
