Abstract

Diğer yandan, İslam ülkelerinde de, kadim İslam Ekonomisi anlayışı varlığını sürdürmekle beraber, Neo-liberal politikaların ürünü konvansiyonel finansal piyasaların giderek artan etkisi de bir gerçektir. Borç ve faize dayalı konvansiyonel finansal piyasalara alternatif olabilecek İslami finans, dünya finans piyasalarındaki artan popülaritesine paralel olarak Türkiye’de de hızlı bir gelişim göstermektedir. Ancak, İslami finans sektörünün gelişimini belirleyen önemli unsurlardan biri de mevcut hukuk sisteminin ve yasaların, İslam hukuk kurallarına uygulanabilirliğidir. Bu çalışma, öncelikle İslami finansın Türkiye ve dünyadaki gelişimi; Türk Hukuku’ndaki kanun, tüzük ve yönetmelikler doğrultusunda, İslami finans ile ilgili düzenlemeleri açıklamaya çalışmaktadır. Çalışmanın amacı, Türkiye’de İslami finans uygulamalarında eksik kalan konuları belirleyip; kanun koyucu tarafından düzenleme yapılması sürecine yardımcı olmak, mevcut düzenlemelerin uygulamada meydana getirdiği sorunları ortaya koymak ve tamamen veya kısmen değiştirilmesi sürecine katkıda bulunmaktır.

Prof. Bilal BAĞIŞ Department : ISLAMIC ECONOMICS AND LAW Sub-field : ISLAMIC ECONOMICS AND LAW Date : The financial sector, along with the development of the global economy, is experiencing a substantial development and transformation process. Over time, it also creates new needs and paves the way for new financial market instruments. On the other hand, in many Islamic countries, although the ancient Islamic economy continues to exist, increasing influence of the conventional Neo-liberal financial markets is a fact. Islamic finance, as an alternative to the debt and interest-based conventional financial markets, shows a rapid development in Turkey, in parallel with the increasing popularity in the world financial markets. Yet, one of the important factors determining the development of the Islamic financial sector is the applicability of the existing legal system and laws to the Islamic rules. This study primarily focuses on development of Islamic finance in Turkey and worldwide; the Turkish laws, rules and regulations, and attempts to explain new regulations related to Islamic finance. The aim of this study is to determine the issues that are missing in Islamic finance applications; to assist the legislators in the process of new regulations, to identify the problems posed by the existing regulations in practice and to contribute to the process of amendments in whole or in part in Turkey
