Seyyid Kutub'un İslam Hukukuyla İlgili Görüşlerinin Analiz ve Değerlendirmesi

Abstract

ÖZET: Araştırmamız Seyyid Kutub’un İslam hukuku alanındaki sosyolojik tespitlerinin analiz ve değerlendirmesini hedeflemektedir. Bu kapsamda araştırmamız Kutub’un İslam hukuku alanındaki tezlerini ele almakta; ibadet, muâmelât ve ukubât alanındaki bazı örneklemlerden hareketle fıkhi perspektifini, fakihlerin yaklaşımıyla mukayese etmektedir. İslam hukukunu sosyolojik bir perspektifle değerlendiren Kutub, İslam hukukunun tarihi olarak geçirdiği evreler, temel özellikleri, sosyolojik açıdan uygulanabilirliği ve diğer hukuklarla mukayesesi konusunda önemli tezler ortaya koymuştur. Kutub’a göre İslam hukukunun toplumda hayat bulması ve gelişip yaşaması ancak rabbani bir yöntemle mümkündür. Çünkü Mekke ve Medine dönemi, vahyin önderliğinde bu rabbani metodun tecelli ettiği en güzel örnektir. Bunun için ilk önce iman konusunun anlatılması ve inanan bir toplumun oluşturulması şarttır. Doğal olarak bu toplum, inandıklarını fiili hayatta yaşamaya başlayınca İslami hükümler ortaya çıkar. Bu araştırmamızda Seyyid Kutub’un İslam hukuku alanındaki tezlerini analiz ederek değerlendirmeye çalışılmıştır. Birinci bölümde Kutub’un hayatı, eserleri ve yaşadığı dönemin sosyal, kültürel, ekonomik ve siyasi durumunu ele alınmış, ikinci bölümde ise İslam hukukunun toplumda uygulanabilirliği ve İslam hukuk düşüncesi ve buna dair analizlerini değerlendirilmiştır. Üçüncü bölümde ise ibadet, muâmelât ve ukubât alanına dair İslam hukukunun bazı hükümlerini nasıl analiz ettiğini ele alarak konuyla ilgili tercih ve yorumlarına yer vermeye çalışılmıştır.

ABSTRACT: Our research aims to analyze and evaluate Seyyid Kutub's sociological findings in the field of Islamic Law. In this context, our research deals with Kutub's theses in the field of Islamic Law; It compares the perspective of jurisprudence with the approach of jurists based on some examples in the fields of worship, treatment and ukubat. Kutub, who evaluated Islamic Law from a sociological perspective, put forward important theses about the historical stages of Islamic Law, its basic features, its sociological applicability and its comparison with other laws. According to Kutub, it is only possible for Islamic law to come to life and develop and live in society with a rabbinic method. Because the period of Mecca and Medina is the best example of this divine method manifested under the leadership of revelation. For this, first of all, it is necessary to explain the subject of faith and to create a believing society. Naturally, when this society begins to live what it believes in actual life, Islamic rulings emerge. In our research, we tried to analyze and evaluate Sayyid Kutub's theses in the field of Islamic Law. In the first part, we discussed Kutub's life, works and the social, cultural, economic and political situation of the period in which he lived. In the second part, we evaluated the applicability of Islamic law in society and the thought of Islamic law and its analysis. In the third part, we tried to give place to his preferences and comments on the subject by discussing how he analyzed some provisions of Islamic law regarding worship, transaction and ukubat.
