Abstract

ÖZET: “el-İtticahatu’t-Tecdid ve’l Muasara fi Mekasidi’ş Şeria” başlıklı bu risalemiz içinde bulunduğumuz çağın önemli konularından birine değinmektedir. Çünkü Eski alimler ve muasır ulemanın İslam şeriatınin maksatlarına dair görüş ve ictihadlarına vakıf olmak Şer’i ilimlerin gelişimi ve yenilenmesi açısından önemli yer edinmektedir. Bu risalenin amacı ve önemi; eski ve muasır ulemanın mekasıd’a dair eserlerini ortaya çıkarması, onların düşünce yapısındaki, yenilenme, birikim ve yapıcılık yönlerine vakıf olmayla orantılıdır. Risalenin önemi, ihtiyac duyulan konulardan Şer’i maksatlar ve tüm alanlardaki rolünden kaynaklanmaktadır. Çalışılan konuda araştırmacı endüktif-analitik yöntemi kullanmıştır. Araştırmada, âlimlerin mekasıd düşüncesinin hala canlılık ve hassasiyet taşıdığı ve araştırmacılar tarafından çok eski ve sık kullanılmasına rağmen “makâsıd” teriminin, amaçlarından sonra kapsamlı bir tanım üzerinde bugüne kadar yerleşmeyeceği, araştırmacı için önemli sonuçlara ulaşmıştır. tarihsel süreci ve eğilimleri karşılaştırırken, araştırmacı, ortak noktalar ve farklılıklar ve çağdaşların amaçlarına ilişkin görüşlerinde ortak özellikler bulmuştur. Araştırmacı, öncelikle talebelere, şeriatın sırlarını ifşa etmek, hükümlerini mazur göstermek, kökenlerine dayandırmak, kurallarını oluşturmak ve musibetlerin şeriatla daha yakından ilgili olup olmadığını araştırmak için meşru amaçlara yönelik meselenin hâlâ acilen çaba sarf etmesi gerektiğini başta ve sonrasında faydalı olması için talebelere tavsiye eder. Çünkü dinde içtihat, bilgelik bilgisidir. Şeriat ve amaçları ve avantajları ve araştırmacı, bilim merkezlerinin ve ihtisas üniversitelerinin teoriden uygulamaya geçmesini ve çoğu şeyin teoriden uygulamaya geçmesini önerir. kasıtlı bağlamda başarılması, soyutlama ve teorileştirmeye yönelir.

ABSTRACT: This study entitled “The Modern Thoughts on the Al-Maqasid of Islamic Sharia”, is a significant topic nowadays, because dealing with these different thoughts, especially the thoughts of the old and the new scholars, forms an important aspect of the development of the Islamic studies. The study aims to explore the effect of the ancient and the modern Islamic scholars on the roots of Al-Maqasid, and what they modernized it, and stand on the aspect of renews, addition and the activity of their theorems.The importance of the study is about the Maqasid Al Sharia and its role in all fields. The researcher has used the analytical approach and the comparison methods throughout the study. The researcher achieved many important results including; the theory of Al-Maqasid among the scholars is a live topic up to now. As long as the term “Al-Maqasid” is and old one, and has been studied much, but there is still no total agreement about its definition among the scholars. While comparing different opinions, the scholar has found that there is an agreement as well as disagreement among the opinions of the ancient and modern scholars.The researcher recommends and advises, firstly the students, that Maqasid al-Sharia is still in need of much more efforts in order to reveal the secrets of the Islamic Sharia Law, explain its provisions, finding its roots, set its fundamental rules and investigate its advantages that served people in their life and even when dead. So, the Islamic Jurisprudence (Fiqh) is having knowledge about the ideal status, the intent, and the advantages of the Sharia. The researcher as recommends the researchers and the universities to transfer from the theoretical filed into the practical one. Especially when the field of Maqasid al-Sharia is mostly theoretical, it is vitally important that researchers seek to find the application of the Maqasid al-Sharia and provide examples practiced in real life.
