Abstract

ÖZET: Kürdistan’da İslam’a birçok açıdan hizmet eden parlak şahsiyetler zuhur etmiştir. Farklı yönleriyle usûl, İslam fıkhı ve hukuka hizmet eden ve bu konuda 60’a yakın eser kaleme alan Prof. Dr.Mustafa Zelmî de (I1924-2016) söz konusu parlak şahsiyetlerden biridir. Tezimizin başlığı “DOKTOR MUSTAFA EZ-ZELMİ’NİN FIKHİ VE KANUNİ GÖRÜŞLERİ (AİLE HUKUKU ÖRNEĞİ)”dir. Bu çalışmada onun ahvâl-ı şahsiyyedeki (evlilik, boşanma, vasiyet ve miras) görüşlerini sekiz mezhebi (Hanefi, Şafii, Hanbeli, Maliki, Caferi, Zeydi, İbâzî Ve Zahiri) kapsayacak şekilde ele aldık. Aynı zamanda onun görüşlerini daha önce yürürlükte olan Irak ahvâl-ı şahsiyye hukukuyla da karşılaştırdık. Çalışmamızda konunun önemi, onu seçmenin nedeni, konu ile ilgili daha önceki çalışmaları, karşılaştığımız zorlukları ve izleyeceğimiz metodu dile getirdik. İki ana başlıklı bir giriş yazdık. Birinci başlıkta Mustafa Zelmi’nin özgeçmişi, ilmi ve metodu; ikincisinde ise konu ile ilgili kavramların tanımı, genelde Irak ahvâl-ı şahsiyye hukukunun tarihi, özelde ise şu an yürürlükte olan ahvâl-ı şahsiyyeye değindik. Tezimizi üç bölüme ayırdık. Birinci bölümde Mustafa Zelmi’nin evlilikle ilgili fıkhi ve hukuki görüşlerini ele aldık. İleri sürdüğü delilleri açıklamak ve onları incelemek için Zelmi’nin görüşleri arasında bazı numuneleri seçtik. İkinci bölümde Zelmi’nin boşanma ile ilgili fıkhi ve hukuki görüşlerine değindik. Bu konuda onun görüşlerinden bazı numuneler seçtik. Konu ile ilgili her görüşünü incelemekle beraber onları fıkhî ve hukukî bir forma da soktuk. Üçüncü bölümde ise vasiyet ve mirasla ilgili Zelmi’nin en önemli görüşlerine yer verdik. Bunlarla birlikte tezimizde sonuç, öneriler, fihrist, Türkçe, Arapça ve İngilizce özetler vardır. Bu çalışmanın Mustafa Zelmi’nin ilmi konumuna layık olacak şekilde başarılı olmasını ve onun İslam fıkhı ve genel hukuka katkı sağlamasını ümit ediyorum.

ABSTRACT: In Kurdistan, brilliant personalities serving several aspects of Islam have appeared. Prof. Dr. Mustafa Zelmi (1924-2016), who served different aspects of Islamic law and jurisprudence, and authored about 60 books on the subject, is one of the abovementioned brilliant figures. The title of the present thesis is "the legal and jurisdictional views of Dr. Mustafa Zelmi in civil status law". In the current study, we tackled his views on civil status issues (marriage, divorce, will and inheritance) based on eight Islamic sects (Hanesi, Shafii, Hanbeli, Maliki, Jafari, Zaidi, Ibazi and Zahiri). Concurrently, his views were compared with the previous Iraqi civil status law. In the present study, we discussed the significance of and the reasons behind selecting Dr. Mustafa Zelmi, his previous work on the subject, the difficulties we encountered and the method we adopted. The introduction section included two topics. The first topic included Mustafa Zelmi's resume, his scientific approach and methodology, while the second topic described the related concepts, introduced the history of Iraqi civil status law in general and the current civil status law in particular. The thesis included three main sections. In the first section, we discussed Mustafa Zelmi's legal and jurisdictional views on marriage. We selected certain views of Zelmi to explain the evidences and examine his views. In the second section, we addressed Zelmi's legal and jurisdictional views on divorce. Thus, we utilized certain views of Zelmi as specimens. We examined every view of Zelmi on the subject, however we organized these views in a juristic and legal form. In the third section, we included the most important views of Zelmi on will and the inheritance. Furthermore, the present thesis includes separate sections for the conclusions, recommendations, resources and Turkish, Arabic and English excerpts. I hope that the present study would be successful and contribute to Islamic law and jurisprudence worthy of the scientific value of Mustafa Zelmi.
