Abstract

ÖZET: Tezimizde 1909(1896)-1987 yılları arasında yaşamış olan Molla Muhyiddîn el-Hâvelî’nin, hayatı, ilmî kişiliği hakkında bilgiler verilecek ve fıkıhçılığı incelenecektir. 20. yüzyılın önde gelen âlim, fakîh ve mutasavvıflarından biri olan el-Hâvelî, soy itibariyle Irak’ın Süleymaniye'ye bağlı Berzenc köyünden gelen ve İslamî ilimlerle meşgul olan bir aileye mensuptur. Siirt’e bağlı Bilvanîs köyünde doğmuştur. Küçük yaşlarda eğitim görmüş ve tedrisat sonrası, Baykan ve Kozluk’un çeşitli köy ve mezralarında bu hizmetlere devam etmiştir. Medrese eğitim geleneğine göre yetişen ve bu gelenek çerçevesinde ders veren el-Hâvelî, çoğu ömrünü ilim öğrenme ve öğretmeye ve insanlar arasında baş gösteren dinî ve dünyevî sorunları çözmeye adamıştır. el-Hâvelî başta Arap dili ve belâgati olmak üzere tefsir, hadis, fıkıh, kelâm gibi İslâmî ilimlerinin hemen her alanında otoritedir. Klasik kaynakları çok iyi özümsemiş olan el-Hâvelî, özellikle Şafiî fıkıh kitaplarına, her satırını ezberlemişçesine vâkıftır. el-Hâvelî, Şafiî mezhebine yeni bir açılım kazandırmaktan çok genelde nakilci bir metot takip etmiştir. Bununla birlikte, farklı görüşlerin olduğu mevzularda mezhep sınırları içerisinde yer yer kendisi de tercihlerde bulunmuştur. Ayrıca kimi zaman da bizzat içtihatta da bulunmuştur. el-Hâvelî, ilmî ve davetçi kişiliği ile de bölgede ön plana çıkmıştır. Özellikle bölge halkının ve âlimlerinin çoğunluğunun itibarını kazanmış önde gelen bir İslâm âlimidir. O yüzlerce talebeye ders vermiş, çok sayıda talebeyi de mezun etmiştir. Talebeleri arasında müderrislik yapan ve önemli hizmetlerde bulunanlar yetişmiştir. Ayrıca elde ettiği ilmi birikimi ile geniş kitlelere dinî ve sosyal alanlarda çok faydalı olmuştur.

ABSTRACT: In our thesis, Molla Muhyiddîn al-Hâvelî, who lived between 1909 (1896) and 1987, was informed about his life, scientific personality, and his fiqh was examined. Al-Hâvelî is one of the leading scholars, fakîh and sufis in the 20th century. He is a member of a family who is engaged in Islamic sciences along with that from the village of Berzenc of Suleymaniye in Iraq. Born in Bilvanîs village of Siirt province. He was educated at a young age and after the education he continued these services in various villages and centers of Baykan and Kozluk. Al-Hâvelî, who grows according to the tradition of the madrasa education and teaches in this tradition, has devoted almost a century of life to learning and teaching science at a large scale and to solve the religious and worldly problems that have begun among people. Al-Hawali is an authority in almost every field of Islamic sciences such as Arabic language and belief, especially commentary, hadith, fiqh, kelam. Al-Hâvelî, who has absorbed classical sources very well, especially to Shafi fiqh books, ascribing to memorize every line. Al-Hâvelî has followed a generally method of transmitting rather than introducing a new opening to the Shafi'i sect. Nevertheless, in places with different opinions, they have found themselves somewhere within the borders of the sect. In addition, he has also occasionally been in jurisprudence. Al-Hâvelî has come to the forefront in the region with his scientific and inviting personality. It is a prominent Muslim scholar who has gained the reputation of the majority of the people and scholars of the region. He has taught hundreds of students and has graduated many students. Among his students are teachers and those who work in important services. In addition, large masses have benefited from the scientific accumulation of al-Hâvelî.
