EL-İ’CÂZU’L- ‘İLMÎ FÎ TAHRİMİ CERÎMETİ’Z-ZİNA VE’L-ÂSÂRU’T-TERBEVİYYE Lİ’T-TARÎM

Abstract

ÖZET Bu tez, zina ayetlerinin incelenmesi ışığında bilimsel ve eğitici yönler arasındaki bağlantıyı incelemektedir. Bu tezin amacı, bu suçun olumsuz etkilerini ve doğru eğitimin gerekliliğini göstermektir. Bu tehlikeli olgudan kaçınmak için, zina suçunun yasaklandığını bilimsel bir şekilde kanıtlamak suretiyle insan aklına hitap ederek, ahlaksızlığın yayılması, ailelerin bölünmesi ile toplumların güvenliğini tehdit eden bu suç olumuz yönlerinin ne olduğunu ortaya koymaktır. Dolayısıyla toplumları korumak için ahlaki eğitimin ne kadar önemli olduğunu ve sorumlu eğitim kurumlarının çok büyük rolü vardır. Bu tezin birinci bölümde zinanın tanımını hem Kur'an-ı Kerim'de hem de Rasûlullah'ın sünnetinde haram kılınmasının delillerini beyan ettik. İkinci bölümde zina suçunun etkileri, sosyal, ekonomik ve tıbbi zararları ele alınmış ve zina olgusunu azaltmak için uygulanabilecek başarılı yöntemleri ele aldık. Üçüncü bölüm, nesillerin yetişmesinde ciddi rolü olan eğitimin temelleri oluşturan medyasının rolü içerir. Tezde, zinaya düşmemek için hem erkeğin hem de kadının büyük rolü vardır. Her ikisi de bakışlarını haramdan koruması, kadınların mahrem yerlerini örtmesi, evlenme engeli bulunmayan erkek ve kadının baş başa kalmaması gibi önlemler bunların başında gelir. Kadınların ve erkeklerin mahrem yerlerini örtmelerinin emredilmesi, zinaya giden yolun bir ölçüde önünü kapatır. Diğer yandan Hz. Peygamber de dil, ağız, el, ayak ve göz gibi organların zinasından söz ederek, zinaya zemin hazırlayan gayrimeşru ilişkilerin, flört ve beraberliğin bir çeşit zina olduğunu belirterek sakındırmıştır. Sapkın davranışlardan uzak bir nesil yetiştirmek için, akademik, hukuki ve eğitimden sorumlu kişilerin toplumun sağlam temeller üzerine inşa edilmesinde büyük sorumluluklar düşer.

ABSTRACT We got a lot of researches that talk about educational contents, and moral values, which has got the spotlight on by a lot of researchers, and with the scientific leap that we are currently facing in our age, which gotten the scientists to build their theories by experiencing them and visually proofing them, therefore scientific miracles are considered one of the main credibility’s to proof the eternal miracle of The “Holy-Qur’an”, and most certainly confirming The prophecy of “Mohammed” -peace be upon him-, and cleansing all the doubts and appeals, and despite the abundance of the researchers in morality crimes and in the Islamic “sharee-a” law and its purpose, The researchers are still aiming to identify the ramification based on it from both the sharia law and legal aspects of it, and the minority whom took care of its scientifical side and aimed to show the scientific facts of these crimes that has been a threaten for humanity, there is almost no highlight on those researches that focuses on the scientific miracles in humanity crimes and taking morality values in consideration; therefore it was necessary presenting scientific miracles and morality values together. This Thesis spotlights on scientifical and moral side upon studying the “Adultery Ayats”; to manifest the negative side of this crime, and how important is the awareness and getting the right ideology are; to avoid this filthy act, therefor by proofing the prohibition of the Adultery crime in logical and scientific manner, which would stop this society threatening crime from spreading , as if it would only spread filth and ugly manners , and that would separate family connections in a way that would only have negative output for the upcoming generation, thus by only revealing the social manners effects on society and the importance of morality element, and by standing against the upper hand that is responsible of the consequences, and building the societies upon noble moral manners, will determines societal development or degeneracy.

ملخص البحث تبحث هذه الرسالة في الربط بين الجانب العلمي والتربوي في ضوء دراسة آيات الزنا؛ لبيان الآثار السلبية لهذه الجريمة، ومدى ضرورة التوعية، والتربية الصحيحة؛ لتفادي هذه الظاهرة الخطيرة، وذلك عن طريق إثبات تحريم جريمة الزنا بشكل علمي مخاطبا العقل البشري، ما لهذه الجريمة التي باتت تهدد أمن المجتمعا ت بذيوع الفاحشة، وتفشي الرذيلة، وتفصم ع رى الأسر، وتهدد النسل والأنساب، وذلك م ن خلال بيان الآثار التربوية في حفظ المجتمعات وأهمية العنصر الأخلاقي، والوقوف عند المؤسسات التربوية المسؤولة عن جمع زمام الأمر، وضبط الجيل بالمبادئ السامية، التي تحدد مدى تقد م، و تماسك مجتمعنا . حيث تطرقت في الفصل الأول إلى بيان الإعجاز العلمي، وتعريف الزنا عند الفقهاء، ومن ثم بيان أدلة التحريم في كل من القرآن الكريم والسنة النبوية المطهرة، كما أشار الفصل الثاني إلى بيان الآثار المترتبة على جريمة الزنا، وما لها من أضرار اجتماعية واقتصادية وطبية، وبيان العلاج الناجح للحد من ظاهرة الزنا، تضمن الفصل الثالث إلى تحديد دور الإعلام التربوي الهادف في بناء الأسس التربوية؛ التي يتربى عليها الجيل، وذلك للوقاية من الوقوع في جريمة الزنا. توصلت الرسالة إلى عدة نتائج منها أن لجريمة الزنا آثار كثيرة لا يمكن علاجها إلا بتفعيل دور حقيقي لكل من الرجل والمرأة على حد سواء، وذلك من خلال بيان الضوابط التي تجب على المرأة مراعاتها كعدم الخضوع بالقول للرجال، وإخفاء الزينة إلا ما ظهر منها، ووجوب التستر والاحتشام، والبعد عن الخلوات، كما يتوجب على الرجل الامتناع عن الاختلاط، وغض البصر، ومراعاة حرمة البيوت. أوصت الرسالة الجهات المختصة الإعلامية منها والأكاديمية والقانونية والتوعوية في العمل على تنشئة الجيل على القيم الفاضلة، والأخلاق النبيلة، وتعميق الأسس التربوية السليمة، وذلك لخلق جيل متسلح بالعلم، بعيداً عن الخوض بالسلوكيات المنحرفة؛ التي تؤدي به للوقوع بجريمة خطيرة كجريمة الزنا.
