Abstract

The significance of the written heritage that we inherited is not lost to anyone thanks to the written and Islamic jurisprudence sciences. Communities that deserve respect and appreciation are those who preserve their heritage and sciences. Furthermore, the heritage provides several advantages for building the future. The present thesis aims to scrutinize the elucidation of the book written in Shafii denomination by Yusuf el-Erdebîlî, titled "el-Envâr lî a'mâli'l-envâr". Because this work was annotated by Kurdish scholar Molâ Muhammed el-Gerdî and it was renamed as "Hâşiyetü Molâ Muhammed el-Gerdî 'alâ'l-envâr'". The book section assigned to me was the part between "bey" (shopping) and "rehn" (collateral) sections. Our modest study was presented to Bingöl University, Social Sciences Institute, Islamic Sciences College, Islamic Law Department as a master's thesis in Islamic Law and Procedures. Our thesis includes an abstract, two sections, result and resources. The abstract includes the methodology of the book, the reason and the significance of selecting this topic, the studies conducted on the book, and finally the methodology of the thesis. The first section is the examination and consists of two parts. In the first, we discussed the author's life, his works, the methodology and resources of his work. In the second part, we discussed the method of the investigation, the name of the book, relevance and the qualifications of the author. The second part includes the analyzed text. It includes the text from the beginning of the "Bey" section until the end of the "rehn" section. The text assigned to me included 29.5 inscriptions. The commentator did not divide the comments on Envar into sections or parts and followed the original sections of the book. In the study, we thoroughly comprehended the text in the work. The two manuscripts that the present study was based on are considered to be the oldest copies. We also demonstrated the locations of all the verses mentioned in the two manuscripts and the sources of the hadiths and the words of the scholars. We also included the biographies of the names mentioned in the work and other explanatory notes required for the text. In the conclusion, we presented the most important results of the investigation and the analysis. I would like to ask Allah the Almighty for taqwa and direction for this study. I pray that my work would be reserved only for Him. I would like the study to be useful to those who write, counsel, read, and benefit from it. He is good God and a good supporter.

Mâhtût ve fıkıh ilimleri ile bize intikal eden mâhtût mirasın önemi kimseye meçhûl değildir. Saygı ve takdiri hak eden ümmetler, miras ve ilimlerini koruyanlardır. Bununla birlikte miras, geleceğin inşasında birçok fayda sunmaktadır. Tezimiz, Şafiî mezhebinde yazılmış ve Yusuf el-Erdebîlî'ye ait "el-Envâr lî a'mâli'l-ebrâr" isimli kitabın şerhini ele almaktadır. Çünkü bu kitabı Kürt âlim Molâ Muhammed el-Gerdî şerh etmiş ve "Hâşiyetü Molâ Muhammed el-Gerdî 'alâ'l-envâr"" olarak isimlendirmiştir. Bu kitaptan "bey'" (alışveriş) bölümünden "rehn" (rehin) bölümünün sonuna kadar tarafımdan tahkik edilmiştir. Mütevazı çalışmamız, İslam Hukuku ve Usûlünde yüksek lisans düzeyini kazanmak amacıyla Bingöl Üniversitesi Sosyal Bilimler Enstitüsü Temel İslam Bilimleri Bölümü İslam Hukuku anabilim dalına sunulmuştur. Tezimiz, önsüz, iki bölüm, sonuç ve kaynakçadan oluşmaktadır. Önsöz, kitabın metodu, bu konuyu seçmenin nedeni ve önemi, kitapla ilgili yapılan çalışmaları ve son olarak da tezin metodunu içermektedir. Birinci bölüm inceleme olup iki kısımdan oluşmaktadır. Birincisinde yazarın hayatı, eserleri, söz konusu eserde izlediği metot ve eserin kaynaklarından bir nebze söz ettik. İkinci kısımda ise tahkikte yapacaklarımı, kitabın ismi, müellife nispeti ve mahtûtun vasıflarından söz ettim. İkinci bölüm ise tahkik edilmiş metinden oluşmaktadır. Bey' bölümünün başından rehn bölümünün sonuna kadar devam etmektedir. Bana ayrılan kısım 29.5 kitabeden oluşmaktadır. Şarih, Envâr'ın şerhini bölüm ve kısımlara ayırmamakta, kitabın bölümlerine olduğu gibi bağlı kalmaktadır. Çalışma esnasında eserin metnini iyice kavradık. Esas aldığımız iki nüsha, en eski nüshalardan sayılmaktadır. Ayrıca iki nüshada yer alan bütün ayetlerin yerlerini, hadis ve âlimlerin sözlerinin kaynaklarını gösterdik. Eserde geçen isimlerin biyografisi ve metin için gerekli olan diğer açıklayıcı notları da yazdık. Sonuç kısmında ise inceleme ve tahkikin en önemli sonuçlarını verdik. Bu çalışma vesilesiyle Yüce Allah'tan takva ve istikameti istemekteyim. Çalışmamın sadece ona mahsus olmasını dua etmekteyim. Onu yazan, danışmanlığı yapan, okuyan ve ondan istifade edenlere faydalı olmasını dilemekteyim. O, ne iyi mevlâ ve ne iyi yardımcıdır.
